ABOUT THESE TERMS These Terms of Service and Terms of Sale (“Terms”) govern access to brushed.me (the “Website”), use of its personalized-artwork features, and purchases of personalized products offered under the Brushed.me brand (“Brushed”, “we”, “us” or “our”). Information about the operator and how to contact us appears in Section 16. By using the Website, uploading content or placing an order, you agree to these Terms. If you do not agree, do not use the Website. Nothing in these Terms limits rights that cannot lawfully be limited, including mandatory consumer rights available in the country where a consumer lives. 2. WHO MAY USE THE SERVICE You must be at least 18 years old, or the age of legal majority where you live, to place an order. A minor may use the Website only with the involvement and permission of a parent or legal guardian. You must provide accurate information and have legal capacity to enter into the purchase contract. 3. HOW THE SERVICE WORKS Brushed allows a customer to upload a photograph, select an available artistic style, receive a computer-generated interpretation, preview it on available products and choose whether to purchase a personalized product. Generated artwork is produced using automated tools. Results may differ from the source photograph and may contain artistic interpretation, simplification, distortion, changed colours, changed details or other imperfections. A preview is intended to provide a reasonable representation, but screen settings, crop, product dimensions, materials and manufacturing may cause the physical product to vary slightly from the preview. You are responsible for reviewing the generated artwork, selected product type, size, colour and other options before purchasing. If you do not like the artwork or preview, do not place the order. We may reject an upload or generation request where the content appears unlawful, unsafe, abusive, technically unsuitable or inconsistent with our content rules. Automated checks can make mistakes. Refusal to process one image does not imply wrongdoing by the uploader. 4. CUSTOMER CONTENT AND PERMISSIONS “Customer Content” means photographs, images, text, instructions and other material you submit through the Website. You retain any rights you already hold in your Customer Content. You represent and warrant that: (a) you own the Customer Content or have all permissions needed to use it; (b) your submission and our processing of it will not violate another person’s copyright, privacy, publicity, image, personality or other rights; (c) where an identifiable child appears, you are the child’s parent or legal guardian or have appropriate permission from the parent or legal guardian; (d) the content is not unlawful, exploitative, threatening, defamatory, deceptive or submitted for harassment; and (e) you are not using the service to create prohibited or infringing material. You grant Brushed a non-exclusive, worldwide, limited licence to host, copy, modify, transmit and otherwise process Customer Content only as reasonably necessary to provide previews, generate artwork, manufacture and deliver products, provide customer support, prevent abuse, comply with law and resolve disputes. This licence includes permission to provide Customer Content to contracted technology and fulfillment providers for those purposes. We will not use a customer’s private photograph or personalized artwork in public advertising or a public portfolio without separate permission. We may remove or refuse content where we reasonably believe these Terms have been violated. 5. GENERATED ARTWORK Subject to these Terms and to the extent Brushed holds transferable rights, Brushed grants the customer a non-exclusive right to use the generated artwork for personal, non-commercial purposes, including displaying the purchased product and sharing photographs of it. Automated outputs may not qualify for copyright protection in every jurisdiction and may not be unique. Similar or identical elements may appear in outputs created for others. Brushed does not guarantee exclusivity, copyrightability or non-infringement of every automated output. Commercial reproduction, resale or licensing of a digital output is not included unless Brushed agrees separately in writing. The Brushed.me name, logos, Website design, software and original brand materials remain protected and may not be copied or used without permission. 6. PRODUCT INFORMATION We make reasonable efforts to display product characteristics, dimensions, materials, available finishes and prices accurately. Minor variation in colour, texture, positioning, edge treatment, crop, frame appearance or dimensions may occur because products are manufactured individually and displays reproduce colour differently. Product photographs and mockups are illustrative. A minor variation that does not affect conformity with the agreed description is not necessarily a defect. This does not limit rights relating to products that are damaged, defective, materially different from the order or not fit for their normal purpose. 7. PRICES, TAXES AND PAYMENT Prices are shown in the currency indicated on the Website or at checkout. Shipping charges, applicable taxes and any other mandatory charges known to us will be displayed before the order is submitted where required by law. Checkout and payment processing are provided through a third-party ecommerce platform and its payment partners. Brushed does not directly receive or store complete payment-card credentials. An order is not accepted merely because a checkout session was created. A binding purchase contract is formed when payment is accepted and the order is confirmed, subject to fraud screening, product availability and our right to correct obvious pricing or technical errors. If a price or product configuration was displayed due to an obvious error, we may cancel and refund the affected order rather than fulfill it at the erroneous price. 8. PERSONALIZED GOODS AND CANCELLATION Every product currently sold by Brushed is made to the customer’s specifications using customer-selected artwork and product options. To the extent permitted by applicable law, personalized goods are excluded from the ordinary right to cancel or return an online purchase merely because the customer changes their mind. For consumers in the European Union or European Economic Area, the ordinary 14-day withdrawal right generally does not apply to goods made to the consumer’s specifications or clearly personalized. This personalization exception does not affect rights relating to damaged, defective, misprinted, incorrect or non-conforming goods. Production can begin quickly after payment. If you need to request a change or cancellation, contact brushed.me.main@gmail.com immediately. We will try to help, but cannot guarantee a change or cancellation after production has begun. If we approve a cancellation before production, the refund will normally be returned to the original payment method. 9. PRODUCTION AND DELIVERY Products are made to order. Unless a different estimate is displayed, please allow approximately 1 to 2 business days for production before dispatch. This is an estimate, not a guaranteed dispatch deadline. Transit estimates shown on the Website or at checkout are estimates supplied by delivery and fulfillment partners. Delays can occur because of production demand, carrier disruption, customs, weather, incorrect addresses, public holidays or events outside our reasonable control. Different products or destinations may be served by different qualified manufacturing and delivery partners. This does not change Brushed’s responsibility to the customer as the seller where applicable law places that responsibility on us. You must provide a complete and accurate delivery address. Contact us immediately if an address is wrong. Once production or shipment begins, an address change may not be possible. Additional costs caused by an incorrect customer-provided address may be charged where lawful and disclosed. Tracking information will be provided when available. A carrier scan marked “delivered” is not always conclusive; contact us promptly if a package cannot be located. International deliveries may be subject to import taxes, duties or customs procedures. Any customer responsibility for such charges will apply only to the extent permitted by law and appropriately disclosed before purchase. Customers should not assume that every destination has identical delivery or customs treatment. 10. DAMAGED, DEFECTIVE, MISPRINTED OR INCORRECT PRODUCTS Damaged, defective, misprinted and incorrect products are covered. Contact brushed.me.main@gmail.com as soon as reasonably possible and provide: (a) the Brushed order ID or Shopify order reference; (b) a description of the problem; (c) clear photographs showing the product, packaging and shipping label where relevant; and (d) any other information reasonably needed to investigate the claim. We may offer a replacement, repair, price reduction or full refund, depending on the circumstances, the customer’s mandatory legal rights and the remedy requested. Where the Website expressly promises a full refund for the applicable problem, that promise will be honoured. Do not return a product to a manufacturer or carrier without instructions from Brushed. An unauthorized return may be lost or sent to a facility that cannot process consumer returns. This section does not shorten any mandatory legal guarantee or statutory period. EU consumers generally have a minimum two-year legal guarantee where goods are defective or do not conform to the contract. 11. LOST, DELAYED OR UNDELIVERABLE SHIPMENTS If tracking has not updated for an unusual period, a package appears lost, or delivery fails, contact us. We may need to wait for a carrier investigation before issuing a replacement or refund. Where a package is returned because of an incorrect or incomplete customer-provided address, refusal, failure to collect or an import charge lawfully assigned to the customer, we may require payment of reasonable reshipping costs before resending it. This does not apply where the failure was caused by Brushed or its providers. 12. CONTACT AND ORDER TRACKING Customers can use the Track Order page with the secure Brushed order identifier supplied in order communications. Keep that identifier private. Anyone who obtains it may be able to view limited order status and tracking information. For support, complaints or privacy questions, contact brushed.me.main@gmail.com. We normally aim to respond within 1 to 2 business days, although complex investigations may take longer. 13. WEBSITE AVAILABILITY We may maintain, change, suspend or discontinue parts of the Website. We do not guarantee that artwork generation, previews, tracking or checkout will always be uninterrupted or error-free. We may impose reasonable technical limits to prevent abuse and control service capacity. We are not responsible for failures caused by the customer’s device, browser, internet connection or unsupported file, except where applicable law provides otherwise. 14. LIMITATION OF LIABILITY Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, fraud, or mandatory consumer remedies. To the extent permitted by law, Brushed is not liable for indirect or purely consequential losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by a person purchasing as a consumer. For customers acting in the course of business, additional limitations may apply, but no limitation reduces payment, refund, replacement or statutory obligations that cannot lawfully be limited. 15. GOVERNING LAW AND CONSUMER RIGHTS These Terms are governed by the laws of the Czech Republic, without depriving a consumer of mandatory protections available under the law of the country in which the consumer habitually resides. We encourage customers to contact us first so that we can attempt to resolve a complaint directly. CHANGES TO THESE TERMS We may update these Terms to reflect legal, operational or service changes. The date at the top identifies the latest version. Changes apply prospectively and do not remove rights already attached to an accepted order. ====================================================================== PRIVACY POLICY ====================================================================== 1. ABOUT THIS PRIVACY POLICY “Personal data” means information relating to an identified or identifiable person. This Privacy Policy explains what we collect, why we use it, who receives it and what choices and rights are available. The identity and contact details of the data controller appear in Section 13. 2. DATA WE COLLECT Depending on how a person uses the Website, we may process: (a) Uploaded content: photographs, filenames and information contained in an image. (b) Generated content: generated artwork, previews, product mockups and related generation selections. (c) Order information: selected product, size, colour, price, order reference, payment status, shipping address, delivery status and tracking information. (d) Contact information: name, email address, message, subject and optional attachments sent through the Contact form. (e) Technical, analytics and security information: IP-derived country, pseudonymous anti-abuse identifiers, anonymous page views and funnel-stage events, request timestamps, browser/device information, server logs and information needed to understand Website use, prevent fraud or misuse and maintain reliability. Brushed does not place photographs, contact details, order tokens or customer identifiers into analytics events. (f) Customer-service information: correspondence, complaint evidence, refund or replacement information and records of how an issue was resolved. (g) Legally required records: transaction, accounting, tax and compliance information that we are required to retain. We do not intentionally collect complete payment-card details. Those are handled by the ecommerce and payment providers used at checkout. 3. HOW PHOTOGRAPHS ARE PROCESSED When a photograph is selected, a copy may be held locally in the user’s browser so it can be carried between Website steps. The photograph is transmitted to contracted automated-processing providers for suitability checks and generation of the requested artwork. The original upload is used to provide the requested service and is not used by Brushed for unrelated advertising. Generated artwork and product previews may be stored so they can be displayed, purchased, manufactured, supported and associated with an order. The current AI API provider states that API inputs and outputs are not used to train its models by default unless the API customer expressly opts in. Provider-side safety and abuse monitoring may nevertheless involve temporary processing or retention under the provider’s terms. Certain content suspected of serious illegality may be retained or reviewed as required by the provider or law. Do not upload a photograph unless you have authority to submit it. Avoid uploading documents or images containing unnecessary financial, health, identity-document or other sensitive information. 4. WHY WE PROCESS DATA AND OUR LEGAL BASES We process personal data for the following purposes: (a) Contract and requested pre-contract steps: to check an uploaded image, generate artwork, create previews, prepare checkout, process payment status, manufacture and deliver an order, provide tracking, handle returns and provide customer support. (b) Legitimate interests: to secure the Website, enforce reasonable usage limits, prevent fraud and abuse, diagnose failures, measure anonymous movement through the creation and checkout funnel, maintain records of service operation, protect legal rights and improve reliability. We balance these interests against the rights and expectations of users. (c) Legal obligations: to comply with tax, accounting, consumer-protection, product-safety, law-enforcement and other binding requirements. (d) Consent: where consent is required for optional analytics, advertising, marketing communications or another optional purpose. Consent may be withdrawn without affecting earlier lawful processing. Where processing is necessary to fulfill an order, refusing to provide the required information may prevent us from providing the service. 5. AUTOMATED CHECKS AND COUNTRY ROUTING Uploaded images may be checked automatically for basic suitability, presence of an intended subject and potential safety-policy issues. An automated check may prevent an image from being processed. The user can normally try a different image or contact support. An approximate country may be derived from network information to select an appropriate product-availability or fulfillment arrangement. This does not determine legal rights, creditworthiness or eligibility for a financial service. Brushed does not use these processes to make decisions that produce legal or similarly significant effects about an individual within the meaning of applicable data-protection law. 6. WHO RECEIVES DATA We disclose personal data only where reasonably necessary to operate the service, fulfill orders, comply with law or protect rights. Recipient categories include: (a) cloud hosting, storage and database providers; (b) automated image-processing and safety providers; (c) ecommerce, checkout and payment providers; (d) print-on-demand, manufacturing and fulfillment providers; (e) shipping carriers and tracking providers; (f) transactional email and customer-support providers; (g) professional advisers, insurers, auditors and authorities where necessary; and (h) a successor or buyer in connection with a legitimate sale, restructuring or transfer of the business, subject to appropriate safeguards. Manufacturing and shipping providers receive the artwork, product specification and delivery information required to produce and deliver the order. They do not need access to Brushed’s source code, credentials or unrelated customer records. We do not sell personal data. We do not disclose private customer photographs for third-party advertising. 7. INTERNATIONAL TRANSFERS Some service providers or their infrastructure may be located outside the Czech Republic, European Economic Area or the customer’s country. Where required, we rely on a lawful transfer mechanism such as an adequacy decision, standard contractual clauses or another safeguard recognized by applicable law. Customers may contact us for more information about the applicable transfer safeguards. 8. RETENTION We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, including fulfillment, customer support, security, legal compliance, accounting and dispute resolution. Retention is determined using the following criteria: (a) unsuccessful or incomplete generation and checkout records are retained only as long as needed for security, diagnosis and cleanup; (b) short-lived anti-abuse records are kept for the applicable rolling usage-control period and operational cleanup; (c) generated artwork and product records may be retained while a preview, checkout, order, support request or legal claim remains relevant; (d) fulfillment and tracking information is retained for customer service, legal guarantees, accounting and dispute resolution; (e) contact messages and attachments are retained for as long as reasonably needed to answer and document the request; (f) privacy-preserving page-view and funnel-event records are retained only while reasonably useful for measuring Website performance and customer drop-off; and (g) transaction and accounting records are retained for the period required by applicable law. Data may be retained longer where necessary to establish, exercise or defend legal claims, comply with a preservation obligation, investigate abuse or protect another person. 9. SECURITY We use reasonable technical and organizational measures designed to protect personal data against unauthorized access, alteration, disclosure, loss or destruction. No internet service can guarantee absolute security. Customers should keep their order-tracking identifier confidential and contact us if they believe it has been exposed or misused. 10. CUSTOMER RIGHTS Subject to applicable law, an individual may have the right to: (a) obtain information about and access personal data; (b) correct inaccurate or incomplete data; (c) request deletion; (d) restrict processing; (e) object to processing based on legitimate interests; (f) receive certain data in a portable format; (g) withdraw consent where processing is based on consent; and (h) complain to a data-protection authority. Requests may be sent to brushed.me.main@gmail.com. We may need to verify identity before fulfilling a request. Rights are not absolute; for example, we may retain information required for an active order, legal obligation, fraud prevention or legal claim. CHILDREN The Website is not directed to children and children may not place orders independently. An adult who uploads a photograph depicting a child confirms that they are the parent or legal guardian or otherwise have appropriate authority. If you believe a child submitted personal data without proper permission, contact brushed.me.main@gmail.com. 12. COOKIES AND LOCAL STORAGE Please see the Cookie and Local Storage Notice below. Brushed uses Vercel Web Analytics for anonymized, cookie-free page-view measurement and a first-party funnel system that records only allow-listed customer-flow stages and safe operational results. The first-party system derives a daily rotating pseudonymous value on the server using network and browser information; the raw IP address is not saved in the analytics table. Neither system uses an analytics cookie or analytics local-storage identifier in the current application. Brushed does not currently deploy advertising pixels or behavioural advertising trackers. Checkout providers may use their own necessary cookies and privacy technologies on their domains. If Brushed later introduces technology that requires consent, it will not be activated for users legally entitled to prior consent until the appropriate choice has been obtained. 13. Questions and privacy requests may be sent to brushed.me.main@gmail.com. ====================================================================== RETURNS, REFUNDS AND COMPLAINTS POLICY ====================================================================== 1. PERSONALIZED PRODUCTS Brushed products are created individually from customer-selected artwork and specifications. We therefore do not ordinarily accept returns or issue refunds solely because a customer changes their mind, selected the wrong option or no longer wants the product. For EU and EEA consumers, the ordinary 14-day withdrawal right generally does not apply to goods made to the consumer’s specifications or clearly personalized. This does not affect legal rights for damaged, defective, misprinted, incorrect or non-conforming products. 2. COVERED PROBLEMS Contact us if: - the product arrives damaged; - the product has a manufacturing defect; - the print is materially misprinted; - the customer receives the wrong product, size or ordered configuration; - the product is materially different from the accepted order description; or - the shipment appears lost or is returned unexpectedly. 3. HOW TO MAKE A CLAIM Email brushed.me.main@gmail.com as soon as reasonably possible. Include the order reference, an explanation and clear photographs of the product and packaging where relevant. Prompt reporting helps us investigate with the manufacturer or carrier. Any suggested reporting period is not intended to shorten a mandatory legal guarantee or prevent a valid claim that applicable law permits later. Do not mail a product anywhere until Brushed provides instructions. 4. REMEDIES Depending on the problem and applicable law, the remedy may be a replacement, repair, price reduction or full refund. Approved refunds are returned to the original payment method unless otherwise agreed or required. Where the Website promises a full refund for a covered damaged, defective, misprinted or incorrect item, Brushed will honour that promise. Original shipping charges will be refunded where required by law or where the entire order cannot be properly fulfilled. Brushed covers reasonable return costs for a confirmed defective or incorrect item where a physical return is required. 5. NON-COVERED SITUATIONS Unless required by law, Brushed is not responsible for: - dissatisfaction with artwork that was clearly shown and accepted before purchase; - minor expected differences between a screen preview and physical materials; - an option or address entered incorrectly by the customer; - ordinary wear, accidental damage after delivery or improper care; - delay caused solely by customs or events outside reasonable control; or - a package lost after the customer directed the carrier to leave it in an insecure place. We will still review each case fairly and mandatory consumer rights remain unaffected. 6. MADE TO ORDER All Brushed products are made to order. Production normally takes approximately 1 to 2 business days before dispatch unless a different estimate is displayed. Production may take longer during unusually busy periods or where an artwork or order requires review. 2. DELIVERY ESTIMATES Available shipping methods and estimated transit times are shown at checkout where available. Production time and transit time are separate. Delivery estimates are not guarantees unless expressly stated as guaranteed. 3. DESTINATIONS AND FULFILLMENT Product availability and fulfillment arrangements may vary by destination. Brushed may use different manufacturing or delivery partners to provide suitable service in different regions. The customer does not need to select a manufacturing partner. We may refuse or cancel an order where delivery to the submitted address is unavailable, prohibited or commercially impracticable. Any captured payment for a cancelled order will be refunded. 4. TRACKING Tracking is provided when made available by the carrier. Customers can use the Brushed Track Order page and Shopify order communications to follow available updates. Tracking may take time to update after a shipping label is created. Contact us if tracking remains unchanged for an unusual period or shows delivery but the package cannot be found. 5. ADDRESS RESPONSIBILITY Customers must provide a complete and accurate address. Contact us immediately after ordering if a correction is needed. We cannot guarantee changes after production or shipment begins. Where a delivery fails because of a customer-provided address error, Brushed may charge reasonable reshipping costs where lawful. We are responsible for correcting errors caused by Brushed or its providers. 6. CUSTOMS AND IMPORT CHARGES International orders may be subject to customs review, import VAT, duties or handling charges. Responsibility for those charges depends on the destination, checkout disclosures and applicable law. Where charges are not included in checkout and may lawfully be assigned to the recipient, the customer is responsible for them. 7. LOST OR DAMAGED PACKAGES Report a lost or damaged package to brushed.me.main@gmail.com. Keep the product and packaging while the claim is investigated. We may request photographs or confirmation from the carrier. If a package is confirmed lost or arrives damaged, Brushed will provide an appropriate remedy in accordance with the Returns, Refunds and Complaints Policy and applicable law. ====================================================================== COOKIE AND LOCAL STORAGE NOTICE ====================================================================== 1. WHAT THESE TECHNOLOGIES ARE Cookies are small files stored by a browser. Local browser storage performs similar functions without necessarily using traditional cookies. 2. CURRENT BRUSHED WEBSITE USE The current Brushed Website may use strictly necessary browser storage to carry a customer-selected image between creation steps and to preserve essential short-lived service state. This storage supports a service specifically requested by the user. Brushed also measures anonymous page views and allow-listed creation, preview, product and checkout funnel stages. Current Brushed analytics do not set analytics cookies or analytics local-storage identifiers. The first-party funnel records a server-derived daily rotating pseudonymous journey value, the stage reached, a normalized route and, where relevant, a short safe failure category. It does not record the uploaded photograph, email, address, order token, generation identifier, Shopify identifier or Printify identifier. The current Brushed application does not intentionally use advertising pixels or behavioural advertising trackers. The checkout service, payment providers and other external pages may use their own cookies under their own notices. 3. CONSENT Strictly necessary storage does not ordinarily require advance consent where it is essential to provide a service expressly requested by the user. Current Brushed analytics are designed without analytics cookies or local-storage identifiers. If Brushed later introduces analytics, personalization or advertising technologies that legally require prior consent, they will not be activated for affected users until the appropriate choice has been obtained. Rejecting non-essential technology must be as easy as accepting it, and withdrawal must remain available. 4. CONTROLS Users can clear cookies and local storage through browser settings. Clearing essential storage may remove an uploaded image or interrupt an unfinished creation or checkout session. 5.
